The Wikimedia Foundation, which runs Wikipedia, has taken its fight for free speech to India’s Supreme Court. It is challenging an order that requires the online encyclopedia to remove a page discussing its legal battle with Indian news agency ANI. Wikimedia argues that complying with the directive would set a dangerous precedent, restricting free speech and limiting access to information.

The dispute began last year when ANI sued Wikimedia for defamation in the Delhi High Court. The agency objected to how it was described on Wikipedia, where it was reportedly labeled as a “propaganda tool” for the government. ANI claimed that its attempts to edit the page with “accurate” information were removed. While the case is still ongoing, the Delhi High Court ruled in October that another Wikipedia page related to the dispute should be taken down, calling it an “interference in court proceedings.”

Wikimedia is now fighting back, asking the Supreme Court to overturn the ruling, emphasising its right to host content about court proceedings. The appeal, filed on January 15, warns that selective and permanent takedowns create a chilling effect on free speech.

The Supreme Court heard the case on Monday and acknowledged it raised important questions about media freedom. ANI has been asked to submit a written response.
